In
these conditions "the company" means
Newland Contracts" and "you" means
a customer who has placed an order with the company.
RISK
The goods shall be at your sole risk from the time at which they
are delivered to you or the carrier at the agreed place of delivery.
TITLE
The title in and ownership of the goods shall remain with Company
until payment is made in full.
DELIVERY
The Company will use its reasonable endeavours to comply with any
delivery date or period agreed with you but shall be under no liability
for any delay in delivery caused or contributed to by any fire,
accident, breakdown, industrial dispute, difficulty in obtaining
materials or any other occurrence or circumstances whatsoever beyond
the control of the Company.
QUALITY
& PERFORMANCE
The Company cannot accept complaints regarding colour, shading,
pattern matching or short measure when the goods have been cut or
fitted by you and in any event any such claims will not be accepted
unless the Company is notified in writing within 3 days of delivery
of goods of the nature of the complaint.
The Company accepts no responsibility for the results of any work
carried out by independent contractors using materials supplied
by the Company, since the Company has no control over their methods
or conditions of use.
No return or cancellation of goods supplied will be accepted by
the Company unless otherwise specifically agreed in writing. In
any event the Company reserves the right to refuse to accept the
return of any goods that are deemed not to be re-saleable such as
nosings that have been cut and drilled and materials ordered specifically
from manufacturers to order. The Company will not accept the return
of screeds and adhesives.
PRICES
Goods will be charged at current prices, as published by the appropriate
manufacturer on date of delivery and are subject to change without
notice. All prices quoted in this booklet were correct at time of
print and are for guide purposes only. The Company reserves the
right to adjust these figures at anytime without notice.
PAYMENT
All prices quoted by the Company are subject to VAT at the current
rate. The price shall be the Company’s quoted price set out
in its current price list unless otherwise agreed in writing by
the Company.
Settlement is due on the 20th of the month following the date of
invoice. If you fail to make payment on the due date you will be
charged interest of 5% per month commencing on the due date for
payment until the actual date of payment.
A bank charge of £20.00 will be applicable per presentation
of any cheque not honoured.
PLACING
AN ORDER WITH THE COMPANY IS ACCEPTING THESE TERMS AND CONDITIONS
